TRUSTEE ELECTIONS
This
bylaw is to provide for the determination of various procedures for the conduct
of general school elections and other trustee elections.
14.1 Preamble
Under the School Act, the Board
of trustees may, by bylaw, determine various procedures and requirements to be
applied to trustee elections.

14.2 Definitions
The terms used shall have the meanings
assigned by the School Act and the Local Government Act, except
as the context indicates otherwise.
"By-Election"
means a trustee election to fill a vacancy on the school board.
"Election" means
trustee election.
"Board" means the Board of Education of School District No. 78 (Fraser-Cascade).
14.3 Application
This bylaw applies to both general
elections and by-elections and to those trustee elections carried out by other
authorities, except otherwise indicated.
14.4 Order
of Names on the Ballot
The order of names of candidates on the
ballot will be determined by lot in accordance with Section 46(5) of the School Act and Section 107 of the Local Government Act.
14.5 Resolution
of Tie Votes after a Judicial Recount
In the event of a tie vote after a
judicial recount, the tie vote will be resolved by conducting a lot in
accordance with section 141 of the Local Government Act.
14.6 Application
of the Local Government Bylaws
a) Where the Board enters into an agreement
with the District of Hope and/or the District of Kent and/or the Village of
Harrison Hot Springs and/or the Fraser Valley Regional District under section
38(4) of the School Act, under which the District of Hope and/or the
District of Kent and/or the Village of Harrison Hot Springs and/or the Fraser
Valley Regional District conducts a trustee election in conjunction with a
local government election, the election bylaws of the District of Hope and/or
the District of Kent and/or the Village of Harrison Hot Springs and/or the
Fraser Valley Regional District, as they may be amended from time to time,
apply to any trustee election carried out under that agreement, except
otherwise provided by Section 38(5) of the School Act and except for the
nomination provisions set out in Section 14.8 of this bylaw.
b) Where the Board conducts an election in
trustee electoral area at the same time as a local government election for the
District of Hope and/or the District of Kent and/or the Village of Harrison Hot
Springs and/or the Fraser Valley Regional District is being conducted, the
election bylaws of the District of Hope and/or the District of Kent and/or the
Village of Harrison Hot Springs and/or the Fraser Valley Regional District, as
they may be amended from time to time, apply to the trustee election, except as
otherwise provided by Section 38(5) of the School Act or by this bylaw
and except for the nomination provisions set out in Section 14.8 of this bylaw.
c) Paragraphs 14.4 and 14.5 of this bylaw
apply to elections carried out by a local government under agreement with the
school board and to elections carried out by the board under (b).
14.7 Elections
Conducted by the Board of Education
(1) Mandatory Advance Voting Opportunities
Mandatory advance voting opportunities
are established as follows:
(a) on the tenth day before general voting
day.
(2) Additional Advance Voting Opportunities
The chief election officer is authorized
to establish additional advance voting opportunities for each election and to
designate the voting places, establish the date and the voting hours for these
voting opportunities.
(3) Additional General Voting Opportunities
The chief election officer is authorized
to establish additional general voting opportunities for general voting day for
each election and to designate the voting places and voting hours, within the
limits set out in section 96(2) of the Local
Government Act, for such
voting opportunities.
(4) Special Voting Opportunities
In order to give electors who may
otherwise be unable to vote an opportunity to do so, a special voting
opportunity is established for each election and the chief election officer is
authorized to establish the location, date and voting hours, within the limits
set out in section 99(4) of the Local Government Act, for a special
voting opportunity.
14.8
Number of Nominators
(1) The
number of qualified nominators for a trustee candidate will be established at
the minimum number of 2 (two) for all electoral regions within the
